At Pediatric Emergency Standards, Inc. (“dba as Handtevy”), we are strongly committed to protecting your privacy. This document sets forth the End User Privacy Policy for and is applicable to Personal Information that is processed by Handtevy on the Handtevy website, mobile applications, and other online offerings (together with any and all future online offerings) operated by or on behalf of Handtevy. By utilizing our applications, visiting the website or corresponding with us electronically, you consent to the collection and use of the information you provide to Handtevy.

Collection of Personal Information

“Personal Information” is any information relating to an identified or identifiable natural person. This may include but is not limited to your name, email address, a unique username and password, or to provide sensitive information in the recovery of your lost password.

The Handtevy applications collect, but are not limited to, 7 data types: Name, Email Address, Device Metadata, Product Interaction, Crash Data, Performance Data and Other Diagnostic Data.

Your Consent

By using the Handtevy application(s), you are agreeing to the collection, use, disclosure and disposal of your personal information and other data as described in this End User Privacy Policy, as it exists now and as it is occasionally updated. This includes the use of “cookies,” collecting, using and storing data, and combining and disclosing data.

The only way you can opt-out of our use or disclosure of your information is to not download or use the Handtevy Application(s).

What We Do with Your Information

Subject to applicable legal restrictions, we acquire, hold, use, and process Personal Information outlined in this Policy or as otherwise clearly identified at point of collection, to (a) provide application functionality and analytics (b) provide product or service information (c) gather customer service information (d) for marketing and/or research (e) to create anonymous and/or aggregated information, etc. For instance, information may be used to authenticate a user, enable Application features, implement security measures, provide usage insights, minimize crashes, and improve scalability and performance.

Anonymized or aggregated information is not Personal Information, and we may use such information in a number of ways, including, but not limited to, research, internal analysis, analytics, and any other legally permissible purposes. We may share this information with third parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.

Handtevy may also use or disclose account information if or when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating the Handtevy Terms of Service or intellectual property rights. The same policy applies in cases where we believe an individual may be causing injury to or interference with (either intentionally or unintentionally) Handtevy rights or property, other users of a site or service, or anyone else that could be harmed by such activities. Handtevy may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.

Information about Cookies and Web Beacons

In order to provide better service for our site, we may use Cookies and Web Beacons to measure site activity and to customize information. “Cookies” are tiny pieces of information stored by your browser on your computer’s hard drive. If you want to disable cookies, there is a simple procedure in most browsers that allows you to turn off cookies. Please remember, however, that cookies may be required to allow you to use certain features of our site.

Web Beacons, sometimes called single-pixel gifs or clear gifs, are used to assist in delivering cookies, and they allow us to count users who have visited pages of our site. Third Party Analytics

We reserve the right to participate with third party analytics partners to monitor and analyze Web traffic such as Google Analytics (Google). You may opt out of the Google Analytics service with the Google’s Browser Add-on that’s available at https://tools.google.com/dlpage/gaoptout/.

Sharing Personal Information with Third Parties

Except as set forth in this End User Privacy Policy or as specifically agreed to by you, we will not otherwise sell or rent your personal information to third parties. However, we reserve the right to transfer your personal information to a third party in the event of a transfer or sale of all or substantially all of our assets.

We may hire other companies to provide services on our behalf, including but not limited to handling customer support inquiries, or other technical expertise. Those companies will be permitted to obtain only the personal information they need to deliver the service. Handtevy takes reasonable steps to ensure that these organizations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

Security of Personal Information

Handtevy will take all reasonable steps to store your information in a secure manner, and to avoid risks such as inadvertent disclosure or unauthorized access. Handtevy’s systems use multi-layered security, including physical security, firewalls, encryption, and full user audit-logging. Handtevy will only store data in Amazon Web Services (AWS) facilities which have been audited to meet appropriate security standards, such as ISO 27001, SOC 1, PCI DSS, and HIPAA (https://aws.amazon.com/compliance/programs/). Handtevy will endeavor to monitor and implement new security measures where appropriate.

The data used for analytics is collected and handled through Google Firebase Android SDK. For all the information collected, Firebase encrypts the data in transit using HTTPS and does not transfer this data to third-parties, except to third-party sub processors that support their services, or to other non-Firebase services Handtevy may choose to connect to.

Third Party Websites

Our site may include links to the websites of our business partners, vendors, etc. To the extent that you disclose your information to other parties, you are subject to the privacy customs and policies of that third party. We are unsure whether these third parties have privacy policies similar to ours, and therefore, Handtevy cannot be responsible for the content or the privacy practices employed by any third party. Please review the privacy policies of these third parties.

Rights of Access, Rectification, and Erasure

You have the right to access, request, amend, and delete your Personal Information, subject to exceptions permitted by law. All requests must be submitted in writing to [email protected]. With respect to our use of general information, you are not able to opt out of the uses set forth in this policy. However, you have the ability to manage the use of cookies on your computer using controls in your browser. To learn more about how to manage cookies, visit http://www.allaboutcookies.org.

You can also request to delete your personal data through the Handtevy Mobile application. This action will remove all of your data from the device, including your profile data. The data related to the patient charts submitted through the Application, will remain in our servers as anonymous records for as long as your organization determines is necessary.

Keeping Children Safe

Consistent with the Children’s Online Privacy Protection Act (COPPA), we will not knowingly collect any information from, or sell to, children under the age of 13. If you are a parent or guardian who has discovered that your child under the age of 13 has submitted his or her personally identifiable information without your permission or consent, we will remove the information from our active list, at your request. To request the removal of your child’s information, please email us at [email protected].

Data retention

The information you provide to us may be archived or stored periodically by us according to backup processes and will only be retained for as long as is required for the purposes for which it was collected, provide our products and services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Effective Date and Changes

Handtevy reserves the right to make amendments to this End User Privacy Policy at any time and in our sole discretion, without notice.
